any longer consider Switzerland as a friendly nation. \u003Cbr \/\u003E \u003Cbr \/\u003E\"The government of Sri Lanka should know the true friends of Sri Lanka without accommodating states, hell bent on making false allegations for political reasons,\" the NJC said in a statement. \u003Cbr \/\u003E Full text of the statement: \"The National Joint Committee condemns the action taken by the Embassy of Switzerland and their government to \u003Cbr \/\u003E \u003Cbr \/\u003Efacilitate the travel of a public official attached to the CID by the name of Nishantha out of Sri Lanka and the subsequent grant of asylum in Switzerland to the said Nishantha. Soon after it was revealed that the Government of Switzerland was behind this high handed and illegal act, the Ministry of Foreign Affairs of Switzerland issued a statement that an official of the Embassy of Switzerland in Sri Lanka had been abducted and detained for two hours by an unidentified group. It is in this situation that the Government requested the identity of this official who is said to be a local employee and a citizen of Sri Lanka for the purpose of investigating the alleged abduction. The Government of Switzerland has refused to divulge the identity of this official or any access to her although they falsely claim that they are cooperating with the investigation. This is obviously because such investigation would reveal the illegal conduct on the part of the Government of Switzerland. \u003Cbr \/\u003E \u003Cbr \/\u003E\"Article 38 (2) of the Vienna Convention on Diplomatic Relations which is codified as a law in Sri Lanka by the Diplomatic Privileges Act No. 9 of 1996 states, \u003Cbr \/\u003E \u003Cbr \/\u003E\"Other members of the staff of the mission and private servants who are nationals of or permanently resident in the receiving State shall enjoy privileges and immunities only to the extent admitted by the receiving State. \u003Cbr \/\u003E \u003Cbr \/\u003E\"So far the government of Sri Lanka has not extended diplomatic privileges to other staff members of diplomatic mission of other countries in Sri Lanka in terms of Section 2 (5) of the said Act. Thus this employee cannot claim diplomatic immunity. This high handed act on the part of the Government of Switzerland, denying access to one of their employees who has no diplomatic immunity is not only illegal but also an affront to the sovereignty of the Republic of Sri Lanka. According to the media reports which appeared today the Government of Switzerland has requested the Government of Sri Lanka to allow this employee to be flown out of Sri Lanka in an air-ambulance on the basis that there \"is rapid deterioration of her health.\" The National Joint Committee wish to remind the Government of Switzerland that if there is \"rapid deterioration of health\" of a citizen of Sri Lanka, it is the responsibility of the Government of Sri Lanka to provide urgent medical assistance to safeguard her life and not the Government of Switzerland. The Sri Lankan Government is fully capable of ensuring the safety of its citizens. \u003Cbr \/\u003E \u003Cbr \/\u003E\"There is a serious doubt whether this employee is to be removed from Sri Lanka against her will for the needs of other interested parties. Therefore before granting authorization by the Government of Sri Lanka it should be satisfied that this request to leave Sri Lanka is made at the request of this employee who is a citizen of Sri Lanka. We also wish to bring to the notice of the Government of Switzerland that obstructing police officers investigating a crime in itself is a violation of the criminal law of this country and the diplomatic immunity extended to the Diplomatic agents of the Embassy of Switzerland does not extend to engage in criminal activities in this country. \u003Cbr \/\u003E \u003Cbr \/\u003E\"The Government of Sri Lanka has a right to know from the Government of Switzerland the reason for suppressing the identity of this particular employee. It is necessary for the Government of Switzerland to make public whether they have any evidence that the Government of Sri Lanka was involved in the alleged abduction to suppress the identity of this employee. If such an allegation is made it is the duty of the Government of Sri Lanka to investigate such complaint. To deprive the Government of Sri Lanka in performing its obligation towards its citizens cannot be permitted for any reason. \u003Cbr \/\u003E \u003Cbr \/\u003E\"It is obvious that this entire drama is to cover up the illegal act on part of the Government of Switzerland and to embarrass the Government of Sri Lanka especially at a time when Geneva session are due in March 2020. \u003Cbr \/\u003E \u003Cbr \/\u003E\"The National Joint Committee note with much regret that even the notorious report of the OHCHR dated 16th September 2015 based its findings on the so called testimonies of witnesses whom the Commissioner withheld the identity. It is unfortunate that western governments with vested interests make use of the UN High Commission for Human Rights to harass and make false allegations on sovereign countries that are unwilling to comply with the dictates of these governments. Unable to find proof of these false allegations the latest is to withhold the identity of the ‘so-called victims’ and to initiate action against countries based on false allegations. The Government of Sri Lanka needs to revisit whether it could any longer treat the Government of Switzerland as a friendly nation that it could extend diplomatic immunity. පර්යන්ත අනු කමිටුවේ සභාපතිත්වය දරන ලද්දේ පාර්ලිමේන්තු මන්ත‍්‍රී ධර්මලිංගම් සිද්ධාදන් මහතාය. එකී වාර්ථාවේ හැඳින්වීමේ සඳහන් වන්නේ ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාවේ ඒකීය ස්වරූපය හේතුවෙන් පළාත් සභාවල ඵලදායී ක‍්‍රියාකාරීත්වය කෙරෙහි බාධාවක් වී ඇති බවයි. ඬේලි මීරර් පුවත්පත නොවැම්බර් 22 වන දින ලබා දුන් සම්මුඛ සාකච්ඡා2වේදී ධර්මලිංගම් සිද්ධාදන් මහතා මෙම තත්වය පිළිබඳව නැවත නැවත ප‍්‍රකාශ කොට ඇත. ඒ අනුව පෙනී යන්නේ මෙම අනු කමිටුවේ ප‍්‍රවේශය වී ඇත්තේ සාංගමික ස්වරූපයේ ව්‍යුහයක් යෝජනා කිරීම බවයි. \u003Cbr \/\u003E\u003Cbr \/\u003Eමෙම ප‍්‍රවේශය පිළිබඳව අප ඉතාමත් කණගාටුවෙන් ශ‍්‍රී ලංකාවේ ඒකීය ස්වරූපය වෙනස් කරන තුරු  ඕනෑම වෙනසකට අපි විරුද්ධ වන බව සටහන් කිරීමට ජාතික ඒකාබද්ධතා කමිටුව අදහස් කරයි. මහජනතාව රැවටීමේ ලේබලයක් වශයෙන් පමණක් ඒකීය භාවය සීමා නොකළ යුතු බව ප‍්‍රකාශ කළ යුතු අතර, ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාවේ අන්තර්ගතයන් ඒකීය ස්වරූපයෙන් විය යුතුය. \u003Cbr \/\u003E\u003Cbr \/\u003Eමේ සම්බන්ධයෙන් පෙන්වා දිය යුතු කරුණක් වන්නේ ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාවේ 13 වන සංශෝධනය ම`ගින් හඳුන්වා දී ඇති ව්‍යුහය විසින් පාර්ලිමේන්තුවේ උත්තරීතර භාවය සහ ස්වාධිපත්‍ය සැලකිය යුතු ප‍්‍රමාණයෙන් ඛාදනයට ලක් වී ඇති බවත්, ඒ නිසාවෙන්ම රාජ්‍යයේ ඒකීය ස්වරූපයට ද හානි වී ඇති බවත්ය. ව්‍යවස්ථාවේ 154 ඨ (3;.* ව්‍යවස්ථාව අනුව පළාත් සභාවකින් පනවන ලද පනතක් අහෝසි කිරීමට හෝ සංශෝධනය කිරීමට පාර්ලිමේන්තු සාමාජිකයන්ගේ 2\/3 ක බහුතරයක් අවශ්‍ය වුවද, පාර්ලිමේන්තුව විසින්ම පනවන ලද නීතින් අවලංගු කිරීමට හෝ සංශෝධනය කිරීමට අවශ්‍ය වන්නේ සරල බහුතරයක් පමණි. පාර්ලිමේන්තුවට 2\/3 ක බහුතරයක් අවශ්‍ය වන්නේ, ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාව සංශෝධනයට පමණක් මිස සාමාන්‍ය නීති සංශෝධනයට නොවේ. එසේ හෙයින් මෙහි ප‍්‍රතිඵලයක් වශයෙන් පළාත් සභාව විසින් පනවන ලද නීති ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාමය ප‍්‍රතිපාදන තත්වයට අප විසින් ඔසවා තැබීමක් සිදු කර තිබේ. මේ අනුව 154 G\u003Cspan style=\"font-family: \u0026quot;arial\u0026quot; , \u0026quot;helvetica\u0026quot; , sans-serif;\"\u003E\u003C\/span\u003E (2) සහ 154 G (3) ව්‍යවස්ථාව අවලංගු කළ යුතුය. \u003Cbr \/\u003E\u003Cbr \/\u003E\u003Cbr \/\u003Eපොලිස් සහ ඉඩම් බලතල සම`ග පළාත් සභා සහ සමගාමී ලැයිස්තු වලට විෂයන් 73 ක් සම්බන්ධයෙන් 13 වන සංශෝධනය ම`ගින් පළාත් සභා වලට ව්‍යවස්ථාදායක සහ විධායක බලතල ලබා දේ. පාර්ලිමේන්තුව එසේ කල්පනා කරන්නේ නම් ජාතික අවශ්‍යතාවය මත එය විසින් පනවන ලද නීති සාමාන්‍ය බහුතරයෙන් අවලංගු කළ හැකි සේම පළාත් සභා විසින් පනවන ලද නීතින් ද, සරල බහුතරයකින් අවලංගු කිරීමට පාර්ලිමේන්තුවට හැකියාව තිබීම අත්‍යවශ්‍ය කරුණක් වන්නේය. ඒ නිසා අපි දැඩි ලෙස අවධාරනය කිරීමට කැමති වන්නේ 13 වන සංශෝධනය මගින් මහජනතාවගේ ස්වාධිපත්‍ය මත ඇති කොට ඇති බාධාවන් ඉවත් කළ යුතු බවත්, 13 වන සංශෝධනයට පෙර පැවැති රාජ්‍යයේ ඒකීය ස්වභාවය ප‍්‍රතිෂ්ඨාපනය කළ යුතු බවත්ය. මෙම උප කමිටුවේ යෝජනා පැහැදිලිවම ගම්‍ය වන්නේ, රාජ්‍යයේ ඒකීය භාවය තව දුරටත් නරක අතට පත් කිරීමේ වැඩ පිළිවෙලක ඔවුන් නිරත වී සිටින බවයි. \u003Cbr \/\u003E\u003Cbr \/\u003Eරාජ්‍යයේ ඒකීය ස්වරූපය පිළිබඳ විරෝධතාවන්ට අමතරව, පවතින ව්‍යවස්ථාවේ ඔවුන්ට එකගවිය නොහැකි ප‍්‍රතිපාදන කිහිපයක් ඉහත කී මධ්‍ය - පර්යන්ත උපකමිටුව විසින් හඳුනා ගෙන ඇත. නම් වශයෙන් :\u003Cbr \/\u003E\u003Cbr \/\u003E    1.     සමගාමී ලැයිස්තුව\u003Cbr \/\u003E    2.    අතිරේක ලැයිස්තුවේ ඇතුළත් ජාතික ප‍්‍රතිපත්තිය\u003Cbr \/\u003E    3.    ආණ්ඩුකාරවරයාගේ බලතල\u003Cbr \/\u003E                          සහ \u003Cbr \/\u003E    4.    මධ්‍යය විසින් කරන මුදල් පාලනය.\u003Cbr \/\u003E\u003Cbr \/\u003Eඅප විසින් පෙන්වා දීමට කැමති වන්නේ ඉන්දියාව සහ දකුණු අපි‍්‍රකාව ඇතුඵ දේශපාලන බලතල විමධ්‍යගත කොට ඇති රටවල් ගණනාවක් විසින්ම ඔවුන්ගේ ව්‍යවස්ථාවන් තුළට සමගාමී ලැයිස්තුවක් ඇතුළත් කර ඇති අතර, ඒ මගින් පළාත් හෝ ප‍්‍රාදේශීය රජයන් විසින් කරනු ලබන වැරදි ක‍්‍රියා වලට මධ්‍ය විසින් මැදිහත් වීමට හැකියාව ඇති කර තිබෙන බවයි. \u003Cbr \/\u003E\u003Cbr \/\u003Eබලය විමධ්‍යගත කරන ව්‍යුහයක් සම`ග ඉදිරියට යාමට නම් මෙම පියවර නිවැරදි දිශාවට තබන ලද පියවරක් ලෙස අපි සලකන්නෙමු. පළාත් රජයන්ගේ ක‍්‍රියාව මගින් ප‍්‍රාදේශීය සුඵ ජාතීන්ගේ අයිතිවාසිකම් වලට බලපෑමක් එල්ල වන්නේ නම්, ඒ ගැන මැදිහත් වීමට මධ්‍යයට අවස්ථාවක් මෙම සමගාමී ලැයිස්තුව විසින් ලබා දෙනු ඇත. \u003Cbr \/\u003E\u003Cbr \/\u003Eආණ්ඩුකාර තනතුර අහෝසි කිරීමට හෝ ඔහු සතු විධායක බලතල ඉවත් කිරීමට ගනු ලබන  ඕනෑම උත්සාහයකට අපි දැඩි ලෙස විරුද්ධ වන බවත්, ඒ ම`ගින් ඔවුන්ට රිසි ලෙස විධායක බලතල පාවිච්චි කිරීමට පළාත් අමාත්‍ය මණ්ඩලයට හැකියාව ලබා දීමටත් අපි විරුද්ධ වෙමු. පළාත් රජයක් විසින් විය හැකි  ඕනෑම අයුතු සහ නීති වීරෝධි ආකාරයේ විධායක බලතල භාවිතා කිරීමකට විරුද්ධව ආණ්ඩුකාර පදවිය හරහා ජනාධිපතිගේ මැදිහත් වීම සඳහා 13 වන සංශෝධනයෙන් හඳුන්වා දුන් 154 G (2) ව්‍යවස්ථාවේ ප‍්‍රතිපාදන සලසා ඇත. අපේ මතය සහ අපි දැඩි ලෙස පෙනී සිටින්නේ පළාත් ඇමතිවරයකු විසින් කරනු ලබන  ඕනෑම නීති විරෝධි සහ නොවිධිමත් වැළැක්වීම සඳහා කැබිනට් අමාත්‍යවරයෙකුට බලතල ලබා දිය යුතු බවයි. ජාතික ප‍්‍රතිපත්තිය පිළිබඳ සියලූම විෂයන් සම්බන්ධයෙන් වු කාරණා වලදී තීරණ ගැනීමට මධ්‍යයට තිබුනු බලතල ඉවත් කිරීමට ප‍්‍රයත්නයක් ගෙන ඇති බව අපි නිරීක්‍ෂණය කරමු. කණගාටුවෙන් වුවත් අපි විසින් සඳහන් කළ යුත්තේ ජාතික ප‍්‍රතිපත්තිය සම්බන්ධ කරුණු ගැන තීරණ ගැනීමට මධ්‍යම රජයට ඇති බලතල ඉවත් කිරීමට ගෙන ඇති උත්සාහය රාජ්‍යයේ ඒකීය ස්වභාවය සහ මහජනතාවගේ ස්වාධිපත්‍ය විනාශ කිරීමේ අරමුණින් කර ඇති එකක් බවයි. මෙම අනු කමිටුවට එක ජාතියක් ලෙස නැගී සිටිම පිළිබඳ අබමල් රේණුවක හෝ සැලකීමක් තිබුනේ නම්, ඔවුන් විසින් මෙවැනි යෝජනාවක් නොකරනු ඇති බවයි.\u003Cbr \/\u003E\u003Cbr \/\u003Eමුල්‍ය ප‍්‍රතිපත්තිය පිළිබඳ බලතල ශ‍්‍රී ලංකාවේ මධ්‍යම රජය සතුව අඛණ්ඩව පැවතිය යුතු බව යළි යළිත් අවධාරනය කිරීමට අප කැමැත්තෙමු. ජාතික ආදායමෙන් යම් ප‍්‍රමාණයක් පළාත් සභාවකට අනිවාර්යෙන් වෙන් කිරීමට යෝජනාවක් ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාවට ඇතුළත් කිරීමට මෙම අනු කමිටුවෙන් කිසියම් යෝජනාවක් කර තිබේ නම්, එය රාජ්‍යයේ ඒකීය ස්වභාවය විනාශ කිරීමට කරනු ලබන, තවත් එක් උත්සාහයක් පමණි. \u003Cbr \/\u003E\u003Cbr \/\u003Eඋතුරු සහ නැගෙනහිර පළාත් ඒකාබද්ධ කිරීමටත් පොලිස් සහ ඉඩම් බලතල පළාත් සභා වලට ලබා දීමටත් ආණ්ඩු ක‍්‍රම ව්‍යවස්ථාවට ප‍්‍රතිපාදන ඇතුළත් කිරීමට අපි දැඩි ලෙස විරුද්ධ වෙමු. ජාතීන් අනුව නියෝජනය කිරීමට බලතල ප‍්‍රදානය කරමින් ව්‍යවස්ථා අධිකරණයක් ඇති කිරීමට ජාතික ඒකාබද්ධතා කමිටුව දැඩි ලෙස විරුද්ධ වේ. ඔවුන්ගේ ජන වර්ගය මත පදනම් වී විනිසුරුවරුන් සහ අනිකුත් නිලධාරීන් තෝරා ගැනීමට ක‍්‍රියා කිරීම ප‍්‍රඥාගෝචර දෙයක් බවට අපි නොසලකන්නෙමු. \u003Cbr \/\u003E\u003Cbr \/\u003Eඑබැවින් අපි ශ‍්‍රී ලංකා රජයෙන් හුදක්ම බලතල ඉල්ලා සිටින්නේ ශ‍්‍රී ලංකාව සඳහා නව ව්‍යවස්ථාවක් සැකසීමේදී මෙම කමිටුව විසින් කර තිබෙන විනාශකාරී යෝජනා ක‍්‍රියාත්මක කිරීමෙන් වලකින ලෙසයි. \u003Cbr \/\u003E\u003Cbr \/\u003Eඅනෙකුත් අනු කමිටු විසින් කර ඇති සියලූම වෙනත් යෝජනා පිළිබඳව සුපරීක්‍ෂාකාරී අධ්‍යයනයකින් පසුව වඩා සම්පූර්ණ ප‍්‍රකාශයක් ඉදිරිපත් කරන්නෙමු. \u003Cbr \/\u003E\u003Cbr \/\u003Eමෙයට\u003Cbr \/\u003E\u003Cbr \/\u003E\u003Cb\u003Eජාතික ඒකාබද්ධ කමිටුය\u003C\/b\u003E\u003Cbr \/\u003E\u003Cbr \/\u003Eඅත්සන - The civil society activist alleged that UNP National List MP Jayampathy Wickremaratne, head of the Public representation Committee on Constitutional Reforms Lal Wijenayake, TNA MP M.A. Sumanthiran et al had been deeply involved in the process therefore the government’s intention was clear.\u003Cbr \/\u003E\u003Cbr \/\u003ECumaratunga pointed out that major political parties namely the UNP, the SLFP, the UNP and the TNA hadn’t made representations to the Six Committees. The NJC spokesperson challenged them to reveal their stand on the controversial reports without further delay.\u003Cbr \/\u003E\u003Cbr \/\u003ECumaratunga expressed concern over the possibility of external powers funding a special project in the guise of a people’s campaign in support of the yahapalana operation.\u003Cbr \/\u003EAttorney-at-law Kalyananda Thiranagama warned of dire consequences unless the on-going process was reversed. Alleging that the Diaspora and the eelamists here would demand the abolition of the Sixth Amendment to the Constitution especially brought in to thwart separatist project, Thiranagama compared the Sri Lanka’s plight with that of former Yugoslavia and Czechoslovakia.\u003Cbr \/\u003E\u003Cbr \/\u003EThiranagama asserted that the country might be divided into four regions with Muslims having a unit of their own.\u003Cbr \/\u003ERetired Rear Admiral Sarath Weerasekera said the country faced division on ethnic lines in spite of huge sacrifices made by the armed forces. The former UPFA Deputy Minister said that eelamists could now achieve their separatist objectives though the LTTE had been eradicated and peace restored in May 2009.\u003Cbr \/\u003E\u003Cbr \/\u003EPresident’s Counsel Manohara de Silva said the on-going process that would certainly weaken the centre.
